Settlement Agreement

Will My Employer Pay My Legal Fees?

How Much Does It Cost?

One of the first questions many employees ask after receiving a Settlement Agreement is, “How much will it cost me to get legal advice?”

The good news is that, in most cases, your employer will contribute towards – and often pay in full – the cost of your independent legal advice.

This is because, for a Settlement Agreement to become legally binding, you must usually receive advice from an independent legal adviser. Employers recognise this legal requirement and will frequently include a contribution towards your legal fees as part of the Settlement Agreement itself.

At Pepperells, we’ll explain exactly how the costs work before any work is undertaken, ensuring you know where you stand from the outset.

Does my employer have to pay my legal fees?

There is no legal obligation requiring an employer to pay your legal costs.

However, because independent legal advice is generally required before a Settlement Agreement can take effect, it is common practice for employers to make a financial contribution towards those costs.

Many employers will:

  • Pay your legal fees in full.
  • Offer a fixed contribution towards your legal fees.
  • Agree to increase their contribution if additional work becomes necessary.

The amount offered varies depending upon the complexity of the agreement and the circumstances of your departure.

Will I have to pay anything myself?

In many straightforward Settlement Agreement cases, you will not pay anything personally because your employer’s contribution covers the legal work required.

However, every case is different.

Additional costs may arise where, for example:

  • Extensive negotiations are required.
  • Multiple revised agreements need to be reviewed.
  • Complex bonus, share option or pension arrangements require detailed advice.
  • There are significant disputes regarding the proposed settlement.

If additional work is likely to fall outside your employer’s contribution, we’ll discuss this with you before any additional costs are incurred.

There are never any hidden surprises.

What if my employer’s contribution isn’t enough?

Occasionally, an employer’s contribution towards legal fees may not fully reflect the amount of work required.

Where this happens, there are often several possible solutions.

Depending upon the circumstances, we may be able to:

  • Ask your employer to increase their contribution.
  • Agree a sensible fixed fee with you.
  • Limit the scope of the work to remain within the employer’s contribution, if appropriate.
  • Discuss alternative funding arrangements.

Our objective is always to ensure that you receive the advice you need whilst keeping costs proportionate and transparent.

Is negotiating my Settlement Agreement worth it?

Many clients ask whether negotiating their Settlement Agreement is worthwhile if it may involve additional legal work.

The answer depends entirely upon your individual circumstances.

For example, negotiation may achieve:

  • A higher compensation payment.
  • Additional notice pay.
  • Payment of bonus or commission.
  • Improved employment references.
  • Changes to restrictive covenants.
  • Better confidentiality provisions.
  • More favourable leaving arrangements.

Even relatively small improvements can significantly outweigh any additional legal costs.

Before recommending negotiation, we’ll discuss the likely benefits, the prospects of success and any potential costs so that you can decide how you wish to proceed.

Are there any hidden costs?

No.

At Pepperells, we believe legal costs should always be discussed openly and honestly.

Before we begin work, we’ll explain:

  • Whether your employer is contributing towards your legal fees.
  • Whether we expect that contribution to cover all of the work required.
  • Whether additional costs are likely to arise.
  • Your options if further work becomes necessary.

You’ll always know exactly where you stand before any additional costs are incurred.

Why value matters more than price

Whilst cost is naturally an important consideration, the value of independent legal advice should not be underestimated.

A Settlement Agreement often determines:

  • The amount of compensation you receive.
  • Your future employment opportunities.
  • Your legal rights.
  • Your employment reference.
  • Your post-employment restrictions.
  • Your financial security during your transition to new employment.

Receiving clear advice at the outset can help avoid costly mistakes and, in many cases, may result in a significantly better overall outcome.

Rather than viewing legal advice as a cost, many clients see it as an investment in securing the best possible conclusion to an important stage of their career.
