Settlement Agreement

Compensation

One of the most common questions employees ask after receiving a Settlement Agreement is:

“Is this a good offer?”

Unfortunately, there is no simple formula that can answer that question.

The value of a Settlement Agreement depends on a wide range of legal, financial and practical factors. Whilst two employees may earn the same salary and have worked for the same employer for the same length of time, the value of their Settlement Agreements could be very different.

Understanding whether an offer is fair requires careful consideration of both your legal position and your personal circumstances.

There is no standard amount

Many people search online hoping to find an average Settlement Agreement payment or a calculator that will tell them what their agreement should be worth.

In reality, there is no standard payment.

Settlement Agreements are negotiated individually and reflect the circumstances of each case.

The amount your employer offers will often depend on:

  • Why the Settlement Agreement has been proposed.
  • Your contractual entitlements.
  • The potential legal claims that may exist.
  • The risks faced by both parties.
  • The commercial objectives of your employer.
  • Whether both parties are keen to reach an agreement quickly.

For these reasons, comparing your offer with someone else’s is rarely helpful.

What factors affect the value of a Settlement Agreement?

When assessing whether an offer appears reasonable, a solicitor may consider a number of factors, including:

  • Your salary and benefits.
  • Your length of service.
  • Your contractual notice entitlement.
  • Any outstanding bonus or commission.
  • Accrued holiday pay.
  • Whether redundancy payments are due.
  • The strength of any potential Employment Tribunal claims.
  • The likelihood of successfully bringing those claims.
  • The costs, risks and time involved in legal proceedings.
  • The impact that losing your employment may have on you.

No single factor determines the outcome. Instead, the overall picture is considered before advice is given.

Does my legal position matter?

Yes.

The strength of your legal position can have a significant impact on negotiations.

For example, your solicitor may consider whether there are potential issues relating to:

  • Unfair dismissal.
  • Discrimination.
  • Whistleblowing.
  • Breach of contract.
  • Failure to follow proper procedures.
  • Redundancy consultation.
  • Wrongful dismissal.

This does not necessarily mean you should bring legal proceedings.

However, understanding the strength of any potential claims helps determine whether the Settlement Agreement represents a fair and reasonable compromise.

Financial value is only part of the picture

Although compensation is important, it is not always the only issue that affects the overall value of a Settlement Agreement.

Other provisions may also be significant, including:

  • The wording of your employment reference.
  • Restrictive covenants.
  • Confidentiality obligations.
  • The agreed reason for your departure.
  • The timing of your leaving date.
  • Ongoing employee benefits.
  • Your employer’s contribution towards legal fees.

In some cases, improving these terms can be just as valuable as increasing the compensation payment itself.

Can the offer be improved?

Possibly.

Many Settlement Agreements are negotiated before they are signed.

Depending on your circumstances, it may be possible to negotiate improvements to:

  • The financial settlement.
  • Notice arrangements.
  • Bonus or commission payments.
  • Restrictive covenants.
  • Confidentiality clauses.
  • Your employment reference.
  • Other practical arrangements that are important to you.

Every negotiation is different, and there is no guarantee that an employer will increase their offer. However, obtaining legal advice ensures you understand whether negotiation is likely to be worthwhile before making a decision.

Beware of online calculators

You may come across websites claiming to calculate the value of your Settlement Agreement in just a few minutes.

Whilst these tools can provide general information, they cannot take account of the legal and commercial factors that often influence negotiations.

They will not know:

  • Why your employer has made the offer.
  • Whether proper procedures have been followed.
  • The strength of any legal claims.
  • Your future career plans.
  • What your employer may realistically be prepared to negotiate.

A personalised assessment from an experienced Employment Solicitor will always provide a more reliable basis for making your decision.

How Pepperells assesses your Settlement Agreement

When you instruct Pepperells, we do far more than simply read through the document.

We’ll consider:

  • Whether the compensation appears reasonable.
  • Your contractual entitlements.
  • Your legal position.
  • The strengths and weaknesses of any potential claims.
  • Whether negotiation may improve the outcome.
  • The wider terms of the agreement and how they may affect your future.

We’ll then provide practical, straightforward advice so that you can decide whether accepting, negotiating or declining the offer is the right course of action.

Every Settlement Agreement is different

No two employees are in exactly the same position.

That is why every Settlement Agreement should be considered on its own merits.

Before deciding whether to sign, it is important to understand not only how much money is being offered, but also whether the agreement represents a fair overall outcome in light of your circumstances.

Independent legal advice gives you the information you need to make that decision with confidence.
