How Settlement Agreements Work

Receiving a Settlement Agreement can feel overwhelming, particularly if it has been presented unexpectedly or you have been asked to make a decision within a relatively short period of time.

The good news is that the process is usually straightforward. With the right legal advice, most Settlement Agreements can be reviewed, explained and, where appropriate, negotiated within a matter of days.

Step 1 – Your employer provides the Settlement Agreement

The process begins when your employer gives you a proposed Settlement Agreement.

This may happen:

  • During a meeting.
  • Following a redundancy consultation.
  • As part of a workplace dispute.
  • Following disciplinary or capability discussions.
  • After a period of sickness absence.
  • By email from your employer or their solicitors.

Alongside the agreement, your employer may also provide:

  • A covering letter.
  • Details of your financial package.
  • An explanation of why the agreement is being offered.
  • Confirmation that they will contribute towards your legal fees.
  • A deadline for signing.

Receiving a Settlement Agreement does not mean you have to sign it immediately.

Step 2 – Contact Pepperells

Step 3 – We review your Settlement Agreement

Step 4 – Deciding whether negotiation is appropriate

Not every Settlement Agreement needs to be negotiated.

  • Improved employment references.

Step 5 – Signing the Settlement Agreement

Once you’re satisfied with the agreement, and any negotiations have been concluded, the Settlement Agreement can be signed.

Your solicitor will complete the independent legal adviser certificate confirming that:

  • Independent legal advice has been provided.
  • The legal requirements have been satisfied.
  • The agreement can now become legally binding.

Only once all parties have signed the agreement will it normally take legal effect.

Step 6 – Payment and moving forward

Following completion of the Settlement Agreement, your employer will make the agreed payments in accordance with its terms.

The agreement will usually specify:

  • When payments will be made.
  • How they will be paid.
  • Which payments are subject to tax.
  • Any continuing obligations, such as confidentiality.

For many people, this marks the beginning of a new chapter.

How long does the process take?

Every case is different.

Straightforward Settlement Agreements can often be completed within a few days.

Where negotiations are required, the process may take longer depending upon the issues involved and how quickly both parties respond.
